Right to be Informed

CRPC SEC 50

At the time of arrest, the person must be informed of the grounds of arrest and their right to bail (if the offense is bailable).

24-Hour Production

ARTICLE 22(2)

Every person arrested must be produced before the nearest Magistrate within 24 hours of arrest (excluding travel time).

Protection Against Self-Incrimination

ARTICLE 20(3)

No person accused of an offense shall be compelled to be a witness against himself. Silence is a legal right.

Special Protections: Women

  • Sun-down Rule: No woman can be arrested after sunset and before sunrise, except in extraordinary circumstances with a woman Magistrate's prior permission.
  • Search by Women Only: A woman can only be searched by another woman officer with strict regard to decency.
  • Section 164 Statement: In cases of sexual offense, the woman's statement must be recorded by a woman Magistrate.
